By accessing Cuppa.tv and providing your Personal Information to us you consent to your personal information being collected, stored and used in accordance with this Policy and that of our service provider.

Overview


In this Privacy Policy, 'us', 'we' or 'our' means the business of Cuppa.tv conducted by Cuppa Of Life Pty Ltd (ACN 661 597 342) and our related bodies corporate (referred to in this Policy as Cuppa.tv). 


Your privacy is important to us and we are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) (Privacy Act), which includes the Australian Privacy Principles and any related privacy codes.


Information we may collect

  1. Personal information

    1. Personal information includes a broad range of information, or an opinion, that could identify an individual and includes:

      1. an individual’s name, signature, address, phone number or date of birth

      2. credit information

      3. sensitive information (as described below)

      4. employee record information

      5. photographs

      6. internet protocol (IP) addresses

      7. location information from a mobile device (as it may reveal user activity)

      8. information contained in any communications between you and us; 

      9. any information about you that you provide through use of our Services, including information you provide if you participate in a survey, promotion or competition.

  1. Sensitive information

The Privacy Act 1988 classifies certain types of information as “sensitive information” – such as information relating to your ethnicity, political affiliation, sexual orientation or religion.  We would not usually collect such information, but there may be circumstances in which we receive such information through our interactions with you.  We will not collect, disclose or use such information without your prior consent.


  1. Deletion

We delete or destroy personal information when we no longer need it unless we are otherwise required or authorised by law to retain the information. 


Why we collect your personal information


We collect and use your personal information in accordance with the Privacy Act so that we can conduct our business and provide our services.  Your personal information is collected and used for the following purposes: 

  1. to provide you with our products and services, including accepting and processing your orders;

  2. to give you information about our services; 

  3. to create your account;

  4. to administer surveys and develop our services in response to information that you provide to us;

  5. to administer promotional activities conducted by us or our business partners;

  6. to send you administrative messages, reminders, technical notices, updates, security alerts and any information requested by you;

  7. to comply with any legal requirements; 

  8. for any related purpose for which we are entitled to use your personal information; and

  9. for any other purpose for which you give your consent.

If your Membership is provided by your employer through its Company Membership, we will provide your employer with information regarding your usage of our services and your Membership.


How we collect your personal information

We collect personal information when you:

  1. set up an account with us;

  2. use our services;

  3. share personal information with us through our services or communicate with us for any purpose relating to our services;

  4. participate in one surveys, promotions or competitions; and

  5. access Content or become a Member of Cuppa.tv, or renew Membership.

We may also receive and collect personal information that you provide to third parties such as service providers, credit agencies, and market companies.


Cookies

We use cookies to collect personal information when you access Cuppa.tv.

  1. Cookies are small data files transferred onto devices from websites. 

  2. When you use or access Cuppa.tv, we may collect information from your device by sending and storing cookies. 

  3. Cookies tell us when you access Cuppa.tv, which pages you visit and the information you download or access.  They also remember your details and preferences so you can easily continue your session when you return to Cuppa.tv. 

If you do not want to activate cookies, you can opt out of receiving them by amending the settings of your browser.  You may find that some parts of Cuppa.tv will have reduced personalisation if you do so. 


Anonymous interaction

There may be circumstances where you wish to contact us on an anonymous basis, such as for a general inquiry.  We may need, at a minimum, your name and contact details to allow us to handle your enquiry or request however we will also hold information about your use of the services on an anonymous or de-identified basis where we do not need to hold personal information about you.

In addition, if you participate in live events that we stream, you will need to provide your name and email address in order to participate.



Disclosure

We may disclose your personal information to the following third parties for the purposes described in this Policy: 

  1. In Australia

    1. our employees, related entities and employees of those entities;

    2. our business partners, including the owners or operators of any app or platform you have subscribed for through us or in connection with us;

    3. payment systems operators;

    4. our sponsors or promoters of any competition that we conduct;

    5. any third parties authorised by you to receive information held by us; 

    6. your employer, if your Membership is provided as part of a Corporate Membership, to whom we may provide usage and interest data and other feedback; and

    7. government, regulatory and law enforcement agencies as required, authorised or permitted by law. 

  2. Outside Australia

    1. We may disclose your personal information to third-party service providers who assist us with our business functions and who may operate from locations outside Australia. As some of these entities are global, we cannot say with certainty where their servers are located or the countries out of which they operate.  These locations may be subject to change without notice to us. 

    2. By providing us with your personal information, you consent to us disclosing your personal information to overseas third parties and acknowledge that we will take reasonable steps to ensure that overseas third parties deal with your personal information in a way that complies with the Privacy Act and the Australian Privacy Principles.

  3. GDPR

    1. The European Union General Data Protection Regulation (Regulation (EU) 2016/679) (GDPR) governs the collection and use of “personal data” within the EU and by Australian businesses:

      1. offering goods or services to individuals in the EU (irrespective of whether payment is required); or 

      2. monitoring behaviour or activity of individuals in the EU.

    2. To a large extent the GDPR overlaps with the Privacy Act but EU users of our services may have additional rights, including in relation to requesting erasure of personal data, monitoring of data collection, and rules regarding the transfer of data overseas.

    3. Cuppa.tv intends to comply with the requirements of the GDPR where it applies to Cuppa.tv’s activities. 

  4. Security

    1. We hold your personal information in hardcopy and/or electronic formats, in secure databases operated by our third-party service providers. 

    2. We protect the personal information we hold through encryption, firewalls and login password protocols, and auditing.

    3. While we take reasonable steps to ensure your personal information is protected from loss, misuse and unauthorised access, modification or disclosure, security measures over the internet can never be guaranteed. This means we cannot guarantee the security of your personal information. In the event of a data breach, we will comply with the required data breach reporting laws. 

  5. External links

    1. Our Platform may contain links to websites, other apps and media platforms operated by third parties.  Those links are provided for convenience and may not remain current or be maintained.  Unless stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites and we have no control over those linked websites. 

  6. The privacy policies that apply to third parties' websites may differ substantially from this Policy, so we encourage you to read those privacy policies before using those websites.

Access and correcting personal information

  1. Accessing your personal information

    1. If you would like to access your personal information, please contact us using the details below. 

    2. While we try to give you access to your personal information free of charge, we may charge you a reasonable fee to cover costs associated with: 

      1. searching for, locating and retrieving your personal information; and

      2. reproducing and sending your personal information.

    3. In certain circumstances, we may not be able to give you access to your personal information and if this is the case will write to you to explain why.  We will try to respond to your request for access within 14 days of receiving your request.  

    4. Correcting your personal information

      1. We try to ensure any personal information we hold about you is accurate and up to date.  If you believe the personal information, we hold about you is inaccurate, out of date or incomplete, please contact us using the details below and we will take reasonable steps to ensure it is corrected. 

      2. We will try to respond to your request for correction within 14 days of receiving your request. 

Complaints 

  1. If you believe your privacy has been breached, or if you have a complaint about our handling of your personal information, please contact us.

  2. If you make a complaint, we will contact you to advise you of the person responsible for managing your complaint and we will try to resolve your complaint within 30 days. When this is not possible, we will contact you within that time to let you know how long we will take to resolve your complaint.

  3. We will investigate your complaint and, if necessary, consult with third parties about your complaint. We will decide how to address your complaint and write to you to explain our decision.

  4. If you are not satisfied with our decision, you can refer your complaint to the Office of the Australian Privacy Commissioner (www.oaic.gov.au).

Updates

  1. We may amend this Policy from time to time.  Any changes to this Policy will be effective immediately upon the posting of the revised Policy on our website. 

  2. By continuing to use our services following any changes you will be deemed to have agreed to such changes.
